General Terms and Conditions of Sale for Online Training Courses

GENERAL TERMS AND CONDITIONS OF SALE OF ONLINE TRAINING COURSES


1. DEFINITIONS:
In these general conditions, the following shall be understood:

  • Consumer : someone who acts for purposes outside of their professional or business activity.
  • Contract/Agreement : Contract/Agreement that is perfected with the acceptance by the Supplier of the purchase proposal made up of the accepted purchase proposal, the terms and conditions and the Privacy Policy.
  • Fee : the fee owed by the User to the Provider for the purchase of each Course or package of Courses, specifically indicated on the Website for each Course or package of Courses at the time of purchase.
  • Courses : means the courses presented on the Website, which the User can purchase individually or cumulatively, including through special offers or packages. Courses are delivered online through video lessons of varying lengths, accessible by registering and accessing the E-learning Platform.
  • Credentials : confidential username and password required to access the Website, communicated to the User via email at the end of the registration procedure.
  • Download : the transfer, usually of file , from a remote computer to a local one, via the Internet (depending on the connection, communication programs, FTP or commands provided by online service client programs are used).
  • Forms : electronic forms present on the Website.
  • Chat : a tool used for each course, aimed at interaction and the exchange of messages between students and the instructor.
  • Supplier : Anna Nail School by Iftoda Ana
  • Member : the User who has registered on the E-learning Platform but has not yet paid the Fee.
  • Material : the teaching material relating to the Course, such as, for example, slide and video lessons.
  • Participant : generally the Consumer or Professional who has purchased a Course.
  • E-learning platform: the platform present on the Website where the Courses and Material are available and through which the Services are provided .
  • Website : the website http://annanailschoolshop.com/
  • Professional : someone who acts for professional or entrepreneurial purposes.
  • Services : services reserved for Members, such as, for example, access to the user area, the issuing of the course completion certificate and the possibility of interacting in the Chat.
  • User : any individual, Consumer or Professional, who accesses the Website.

2. OBJECT OF THE Contract/Agreement
  • The Contract/Agreement governs the use of the Website, the purchase by the User of one or more Courses and the provision of the Services, against payment of the Fee.
  • The presentation of the Courses on the Website constitutes an invitation to Website Users to submit a purchase proposal to the Supplier. This invitation to submit a proposal is not binding on the Supplier and does not constitute an offer to the public. Any decision regarding acceptance of proposals submitted by Website Users remains at the Supplier's sole discretion.
  • The Contract/Agreement between the User and the Supplier is deemed to be perfected when the Supplier receives evidence of payment of the Fee.
  • The Provider reserves the right to modify the terms and conditions at any time by notifying Users on the homepage of the Website. In such case, the changes will be effective for legal purposes from the date of notification, without the need for specific and further approval and will apply to Agreements concluded after such modifications and/or additions.
3. OBLIGATIONS RELATING TO THE USE OF THE E-LEARNING PLATFORM
  • The User undertakes to:
  • use the Website in accordance with the Agreement;
  • not to use the E-learning Platform and its Services for illegal purposes or in violation of the Contracts/Agreements, nor in ways that could damage the functionality of the Website, making it unusable, causing overloading, deterioration and/or interference with the use of the same by other Users.
  • Any behavior that, even through mere attempts, could result in unauthorized access to the E-learning Platform, the Services, other accounts, systems or networks connected to the Website, through hacking, password forgery or other means, is prohibited.
4. HOW TO PURCHASE COURSES AND PARTICIPATION
  • Purchase procedure
Users wishing to purchase and participate in one of the Courses can select the Course of interest directly from the Website and follow the registration and purchase procedure.
Once the Course has been selected, the User will be directed to a web page containing the Course's technical specifications, summarizing pre-contractual information such as the Course description and program, the Fee, payment methods, and the right of withdrawal. By clicking "BUY NOW," the User will add the Course to the virtual cart.
To register for the E-learning Platform, the User must complete the appropriate form, taking care to enter the required data in each field. Fields marked with a special symbol (e.g., *) must be completed for registration.
Successful registration and subsequent enrollment in the Course is subject to (i) acceptance of the terms and conditions, review of the Privacy Policy, and consent to the processing of the data provided. Once registration is complete, the User will receive an email at the address provided during registration containing the credentials for accessing the E-Learning Platform.
Members can purchase a course by clicking the "BUY NOW" or "SIGN UP FOR THE COURSE" button. A page will appear listing the courses available for purchase and the applicable fee. Members can complete the purchase order by paying the fee via credit card, PayPal, or online bank transfer.
If paying by credit card, the Member agrees to the Provider charging the Course Fee to the credit card provided during registration. The credit card details are not available to the Provider and are stored in the payment service provider 's systems . The credit card details are accessible only to the User for any changes and/or updates using the Credentials. The purchase will not be finalized if the credit card has expired at the time of purchase.
Payment by credit card may be subject to manual checks of the banking transaction and may delay access to the Course. The credit card number, via a 128-bit SSL encrypted data channel, is sent from the browser directly to the banking network's secure server, which verifies the availability of credit and communicates the outcome to the Provider's system. Since the transaction occurs on the banking network's systems, the Provider declares and the User acknowledges that the Provider does not retain the credit card information provided during registration.

  • Payment by installments
Installment payments allow you to pay the entire Fee in multiple monthly installments. This payment method is intended as a deferred payment of the total Fee due, and not as a subscription. The Participant undertakes to pay all scheduled installments until the balance is paid.
If the Participant cancels the recurring charge before reaching the Fee balance, or if even a single monthly payment is not successfully made, the Participant will lose the benefit of the granted deadline. Access to the Course will be disabled immediately without notice and will be reactivated only after the Fee balance has been paid within 48 hours of the disabling date. If the Fee balance is not paid within the aforementioned deadline, the Contract/Agreement will be deemed terminated and the Supplier may initiate debt collection proceedings.
  • Course Conduct
The courses are available online through the E-learning platform made available to participants, who can follow the lessons at any time after activation.
5. SERVICES AND METHODS OF DELIVERY
  • Reserved area
The credentials received by the User via email are personal and cannot be transferred to third parties. In the event of password loss, a specific procedure is provided for its recovery.
From the reserved area you can access and modify your data, including your access password.
  • E-learning Platform
Access to the E-learning Platform is permitted only to Users with Credentials. Courses are held through the E-learning Platform and have no time limits on participation. The E-learning Platform contains Course Materials, which Participants can view and download even after the Courses have concluded and as long as the User's profile remains active.
6. SUPPLIER'S OBLIGATIONS
  • The Provider undertakes to guarantee access to the Services offered by the E-learning Platform to Users who have correctly completed the registration and purchase procedure for the Courses.
  • The Provider makes available to the Participant a reserved area containing personal data and further information relating to the selected and purchased Courses.
  • The Supplier shall set up the system so that the Participant can access, within the established timeframes, the Course Material and carry out the download slides or in mode streaming for videos where applicable, / regardless of how they are performed, at any time (always in compliance with the terms indicated in the Contract/Agreement) and, for Courses used, until the User requests the cancellation of his/her profile.
  • The Supplier undertakes to provide a specific certificate upon completion of the Courses and passing the tests. The Certificate will be sent via the email address indicated by the participant or can be sent in paper form upon request by the Customer, providing the address is provided.
  • The course completion certificate is issued only if the entire fee has been paid.

7. OBLIGATIONS OF THE USER/MEMBER/PARTICIPANT
  • By creating their profile and completing the registration form, the User who intends to register undertakes to provide their personal data correctly and truthfully and not to upload illegal content.
  • The User undertakes to:
  • pay the Fee for the selected Course according to one of the indicated methods;
  • keep with the required diligence the authentication credentials necessary to access your reserved area and the E-learning Platform;
  • use the Course Materials only for the purposes indicated in the Contract/Agreement.
  • Any form of contact between Users aimed at promoting goods or services and, more generally, any activity of spamming or that violates applicable law or may disturb other Users.
8. RIGHT OF WITHDRAWAL
  • The Participant may withdraw from the Contract, without penalty and without having to specify the reason, within 14 calendar days from the purchase of the Course . The withdrawal must be exercised, within this period, by sending an email at annanailschoolshop@gmail.com , or a registered letter with return receipt containing:
  • the printed and signed terms and conditions;
  • The Privacy Policy printed and signed;
  • Copy of a valid identity document and tax code;
  • Copy of the activation email containing the Credentials.
  • The Participant may also exercise the right of withdrawal by sending the standard withdrawal form in the attachment below:

  • Any request that does not comply with the provisions of the Consumer Code or the Contract/Agreement will not be processed. Not it will be possible to exercise the right of withdrawal:
  • after the fourteenth day from the date of purchase of the Course;
  • if the Participant, even before 14 calendar days have passed from the purchase of the Course, has viewed more than 5% of the total Course.
  • In the event of a valid withdrawal, the Supplier will be required to refund, free of charge, the Fee received within 14 calendar days of receiving the notice of withdrawal. The refund will be made using the same payment method used by the User for the purchase, unless otherwise agreed. Following withdrawal, the User will be barred from accessing the E-Learning Platform.
9. COURSE CHANGES
  • The Provider reserves the right to make changes to the content of the Courses and the composition of the teaching staff at any time and without notice.
  • Members who have purchased the Course in the past will be able to access the new materials for free.
10. DISCLAIMERS
  • Except in cases of willful misconduct or gross negligence, for which no limitation shall apply, the Supplier's liability is limited to the obligations undertaken under the Contract/Agreement and the maximum liability that the Supplier may sustain as a result of any claims arising from breach of contract or non-contractual liability will be limited to the resulting damages only and, in any case, may not exceed an amount equal to the Fee paid by the User.
  • The Provider is not liable to the User or to any party directly or indirectly connected to them for delays, disruptions, or suspensions of the Website that are the responsibility of third parties or caused by force majeure or unforeseeable circumstances (including, but not limited to, suspension, slowdown, or malfunction of the Website or electricity supply, malfunctions of the internet network or internet service provider, or of the software used to provide the service, impediments or obstacles caused by provisions of law or acts of national or foreign authorities, legal provisions or acts or acts of third parties, wars, strikes, pandemics, or other causes not directly attributable to the Provider); for an increase or failure to increase the User's business, for failure to achieve the desired results in light of investments and costs incurred, and for any damage resulting from teaching; for tampering with or interventions by third parties on services or equipment used by the Provider or the User; for incorrect use of the E-Learning Platform by Users; malfunction of connection devices used by Users; non-conformity and/or obsolescence of devices or programs used by the User or third parties; problems or disruptions related to hosting and domain; for service malfunctions, data loss, accidental disclosure of personal or sensitive data, and any other type of damage resulting from attacks by pirates, thieves, hackers, crackers, viruses, and the like.
  • You agree that the Provider shall not be liable for any omissions or errors that may be contained in the Materials, nor for any infringement of third party rights and for any damages, including indirect, consequential, or other damages of any kind, including damages resulting from loss of use, loss of data, or loss of profits, or arising from breach of the Contract, negligence, or other tortious actions, arising out of or in any way connected with the use of or information available on the Website.
11. INTELLECTUAL PROPERTY RIGHTS
  • The purchase of one or more Courses, the use of one or more Services and/or navigation on the Website and/or access to the E-Learning Platform by the User and/or the Member and/or the Participant does not prejudice, limit, affect, restrict and/or condition, in any way, any property right, license and/or right of use by Anna Nail School of Iftoda Ana of the trademarks and patents (registered or not), software , know-how , trade names and copyrights (whether or not registered or registrable), domain names, databases , procedures, contents, technical knowledge, empirical data and/or industrial and commercial processes used, recorded, held and/or in any case present on the Website, in the E-Learning Platform, in the Materials or in any other context and for any reason reproduced by the same Anna Nail School of Iftoda Ana (collectively, “ Industrial and Intellectual Property Rights ”).
  • The purchase of one or more Courses, the use of one or more Services and/or browsing the Website and/or accessing the E-Learning Platform does not give rise, even temporarily or partially, to any right, faculty and/or other legal position of the User and/or the Member and/or the Participant on the Industrial and Intellectual Property Rights of Anna Nail School di Iftoda Ana, who neither have nor will acquire any right, faculty and/or title to use, commercialize and/or in any case dispose of or benefit from any Industrial and Intellectual Property Rights.
  • All forms of text, programs, audio and video, hypertext processing, and all parts of the Courses, Materials, Website, and E-Learning Platform are protected by copyright law and may not be copied or reproduced (even in other formats or on different media), nor may their authorship be appropriated.
  • Reproduction by any means, format, or medium, quotation, communication, or public disclosure by any means (including online), translation, or any type of adaptation, in whole or in part, of the Courses, Materials, Website, or E-Learning Platform is prohibited and sanctioned. Any unauthorized reproduction will be prosecuted.
12. SUPPLIER'S TOLERANCE – INVALIDITY OF ONE OR MORE CLAUSES
  • Any tolerance by the Supplier of non-compliant behavior by the User and/or the Member and/or the Participant as set forth in the Contract/Agreement does not constitute an implied waiver by the Supplier of the rights to which the latter is entitled under the same Contract/Agreement.
  • The invalidity of individual clauses contained in the Contract/Agreement does not entail the invalidity and/or ineffectiveness of the entire Contract/Agreement.
  • The parties declare that they have read these general conditions of the Contract/Agreement.
